style=\"font-weight: 400;\">, regardless of whether the debtor is a Spanish resident or not.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Applicable_law_to_the_application_for_the_exequatur_of_a_foreign_insolvency_proceeding_in_Spain\"><\/span><b>Applicable law to the application for the exequatur of a foreign insolvency proceeding in Spain\u00a0<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Depending on the State in which the declaration of insolvency has been issued, the <\/span><b>recognition of foreign insolvency proceedings in Spain<\/b><span style=\"font-weight: 400;\"> will be subject to one or another rule.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the declaration of insolvency has been issued by a non-EU member Court, the application for exequatur will be governed by the <\/span><b>Spanish Law no. 29\/2015 of international legal cooperation in civil matters (LCJIC)<\/b><span style=\"font-weight: 400;\">, whereas, if the declaration of insolvency of the debtor has been issued by an EU member Court, the application for exequatur will be governed by the <\/span><b>Regulation (EU) No. 1215\/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction, and the recognition and enforcement of judgments in civil and commercial matters (the Brussels I bis Regulation).<\/b><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Application_for_provisional_measures_on_the_debtors_assets_based_in_Spain\"><\/span><b>Application for provisional measures on the debtor\u2019s assets based in Spain<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">It is also possible to apply for <\/span><b>provisional measures<\/b><span style=\"font-weight: 400;\"> on the debtor&#8217;s assets based in Spain (even &#8220;ex parte&#8221;), such as the <\/span><b>prohibition on the disposal of assets<\/b><span style=\"font-weight: 400;\">, which prevent that the debtor dispose of his patrimony in the time that elapses between the application for exequatur and the recognition of the foreign insolvency proceedings in Spain.\u00a0<\/span><\/p>\n<p><span
